Order BEFORE: KEITH, BROWN, and MARTIN, Circuit Judges This matter is before the Court for consideration of appellant's response to this Court's order to show cause why the appeal should not be dismissed for lack of jurisdiction due to a late filed notice of appeal. It appears from the record that the judgment denying habeas corpus relief was entered on May 1, 1979. It further appears that on June 11, 1979, the District Court received a motion from appellant for a certificate of probable cause and for leave to appeal in forma pauperis. It further appears that this June 11, 1979 filing was sufficient to constitute a notice of appeal. Appellant's notice of appeal filed on June 11, 1979, was eleven days late. Rule 4(a), Federal Rules of Appellate Procedure. The late filing of a notice of appeal deprives an appellate court of jurisdiction to entertain the appeal. Browder v. Director, Department of Corrections, 437 U.S. 527 (1978); Levisa Stone Corp. v. Elkhorn Stone Corp., 411 F.2d 1208 (6th Cir. 1969), cert. denied, 397 U.S. 925 (1970).
